ISLAMABAD — The federal government has introduced the 27th Constitutional Amendment Bill, a proposal that could bring sweeping changes to Pakistan’s judicial framework and military leadership structure. The bill has been presented before the Senate and referred to the Standing Committee on Law and Justice for detailed scrutiny.
Officials say the amendment seeks to implement reforms long discussed under the Charter of Democracy but never fully realized. If passed, it could reshape both governance and institutional authority across the country.
- New Military Leadership Structure
The amendment introduces a major overhaul in how Pakistan’s armed forces are managed:
A new position called Chief of Defence Forces (CDF) will become the highest military role.
The Chief of Army Staff (COAS) will automatically assume this new role.
Lifetime honorary titles such as Field Marshal, Marshal of the Air Force, and Admiral of the Fleet will be formally recognized.
Parliament will have exclusive authority to revoke these honorary ranks.
The Prime Minister will appoint the commander of the National Strategic Command based on recommendations from the CDF.
- Establishment of a Federal Constitutional Court
A landmark feature of the amendment is the creation of a Federal Constitutional Court to handle constitutional interpretation and disputes:
Certain powers of the Supreme Court will transfer to the new court.
All provinces will have equal representation.
The Chief Justice of this court will serve a three-year term.
Parliament will decide the number of judges, while the President and Prime Minister will play leading roles in appointments.
- Updates to Article 243
Changes to Article 243, which governs armed forces command, are also proposed:
Authority and responsibilities between federal institutions will be redefined.
The federal government’s role in military command will be clarified to ensure balance.
- Other Constitutional Adjustments
The President will gain lifetime immunity from criminal cases.
Selection processes for key defence roles will shift more power to elected bodies.
Certain constitutional responsibilities will be redistributed to create institutional balance.
If approved, the 27th Constitutional Amendment would bring historic changes creating new military leadership roles, establishing a separate constitutional court, and adjusting the powers of existing bodies like the Supreme Court. Parliament’s debates and committee reviews will determine the final shape of this landmark proposal.
