Ex-Judge Petitions Court for Sindh Governor’s Removal over Alleged Constitutional Violations

KARACHI:
A former judge has approached the Sindh High Court, seeking the removal of Governor Kamran Khan Tessori on the grounds of alleged constitutional breaches and promotion of ethnic politics.

The petitioner, retired judge Ahmed Ali Gabol, argued that Governor Tessori has violated the oath of his office by failing to remain impartial. In his petition, Gabol claimed that the governor has repeatedly engaged in political activity favoring specific groups, while also making remarks that encouraged ethnic and provincial divisions.

The petition accused Tessori of addressing gatherings at the Governor House and elsewhere where he allegedly spoke about separating Karachi from Sindh and appealed directly to the Urdu-speaking community conduct that, according to the petitioner, amounts to inciting linguistic polarization.

Citing Articles 4, 2, 25, and 32 of the Constitution, the petition stated that Tessori’s actions undermine equality, social harmony, and the principle of federal unity. It also referenced Supreme Court judgments that explicitly bar the use of public offices for political purposes.

The petition further contended that under Article 101(3) of the Constitution, the President of Pakistan is bound to remove a governor who engages in political activity. “The office of governor is a non-political institution,” the petitioner maintained, adding that Tessori has misused both his authority and the Governor House to serve the interests of a particular political party.

Respondents named in the case include the federal law and justice secretary, the cabinet division secretary, and the principal secretary to the Sindh Governor. The petition emphasized that the governor’s office must remain a symbol of national cohesion and provincial harmony, rather than a platform for political agendas.
